Kerala Clinical Establishments Act — Rate Display, Grievance Desk and What Hospital Administrators Must Manage

In November 2025 the Kerala High Court upheld the Kerala Clinical Establishments (Registration and Regulation) Act, 2018 and set out what every hospital must display, hand to patients and record. The Supreme Court is now hearing a challenge — but the compliance work itself lands on the hospital's administration team.

Quick Answer: What does the Kerala Clinical Establishments Act require hospitals to do?

As upheld by the Kerala High Court on 26 November 2025, hospitals must prominently display their list of services, baseline and package rates, key facility information, a summary of patients' rights and grievance-officer contacts in Malayalam and English at the reception or admission desk and on their website; give patients a bilingual information brochure; never deny initial life-saving aid for non-payment of advance or lack of documents; and run a grievance desk that logs every complaint and aims to resolve it within seven working days. Private hospital bodies have challenged the Act in the Supreme Court, which granted interim protection from coercive action — so hospitals should track the case's current status.

What Hospitals Must Display

At the reception / admission desk and on the official website, prominently, in Malayalam and English:

  • The list of services offered
  • Baseline rates and package rates for commonly performed procedures
  • Key facility information
  • A summary of patients' rights
  • Grievance-officer contact details

Displays must be kept current, showing the date of revision whenever rates or contact details change.

Patient Brochure, Emergency Care and Discharge

  • Patient information brochure in Malayalam and English, given at admission and downloadable from the website — covering services, rates with deposit and refund policy, insurance/TPA procedures, estimate and billing policy, discharge, ambulance charges, the 24×7 emergency protocol and grievance redressal.
  • Emergency care: screen and stabilise emergency patients within the hospital's capacity and arrange safe, documented transfer when needed. No hospital may deny initial life-saving aid on the ground of non-payment of advance or lack of documents.
  • At discharge: hand over the discharge summary and all investigation reports — ECG, X-ray, CT and other test reports.

The Grievance Desk — How It Must Work

  1. Maintain a grievance desk or helpline.
  2. Log every complaint with a unique reference number and acknowledge it immediately (SMS, WhatsApp or in writing).
  3. Aim to resolve complaints within seven working days.
  4. Escalate unresolved or serious matters to the District Registering Authority / DMO.
  5. Keep a complaint register available for inspection and summarise grievances in monthly compliance reports.

The High Court also directed hospitals to file an undertaking of compliance within 30 days, with verification audits by the District Registering Authority to follow.

Where the Case Stands

The Kerala Private Hospitals Association and the IMA challenged provisions of the Act — including the rate-display requirement — arguing that terms such as "fee rate" and "package rate" are not defined. After the High Court dismissed their appeals, the Supreme Court issued notice and directed that no coercive action be taken against the petitioners for now, listing the matter for hearing in February 2026. Why This Is Hospital Administration Work

Rate boards, bilingual brochures, website updates, the grievance register, monthly compliance reports and the undertaking to the District Registering Authority are all run by the administration side. In practice they sit with the front office, patient relations, billing and quality teams — and they connect directly to the patient-rights work assessed under NABH accreditation.

How Treneywann Teaches This

Treneywann updates its hospital administration curriculum as rules change. The Kerala Clinical Establishments Act is taught as practical desk work — bilingual rate displays, the patient information brochure, grievance-desk procedure and compliance reporting — within the front office, patient relations and quality training, with hands-on practice in India's only live Hinall HMS lab at Vyttila, Kochi.
